Krafton pulled Battlegrounds Mobile India off the app stores on 28 July 2022 on a government order over data-privacy concerns, and for ten months the country's biggest mobile esport simply did not exist. It came back in late May 2023, on 27 May for Android and 29 May for iOS, and the scene recovered faster than anyone predicted. In 2026 the competitive side is thriving. The betting side is a different story, and if you have read an older guide that told you the answer depends on which Indian state you are sitting in, that guide is out of date. India now has a single federal prohibition on online money games, and it is not a grey area.
One Federal Ban, Not a State-by-State Map
Parliament passed the Promotion and Regulation of Online Gaming Act, 2025, which received presidential assent on 22 August 2025. The Ministry of Electronics and Information Technology then notified the Promotion and Regulation of Online Gaming Rules, 2026 by notification G.S.R. 303(E) dated 22 April 2026, and the framework came into force on 1 May 2026.
The Act defines an online money game as an online game in which a user pays money or stakes something of value expecting monetary or other enrichment in return, and it says so regardless of whether the game turns on skill, chance or both. That single line retires the decades-old skill-versus-chance argument that Indian operators had built their licensing case on. Staking your own money on the outcome of a BGMI match sits squarely inside the definition.
Gambling is still a state subject for offline betting, and the old state statutes and the Sikkim and Nagaland licensing regimes are still on the books. But for online real-money play there is now a national prohibition sitting on top of all of them. Which state you are in no longer changes the answer.
What the Law Actually Prohibits
The Act draws three separate lines:
- Offering an online money gaming service, or aiding and abetting anyone who does.
- Advertising or promoting one, through any medium, directly or indirectly.
- Moving the money. No bank, financial institution or payment intermediary may facilitate or process a transaction towards an online money gaming service.
The penalties are criminal, not administrative. Offering such a service carries imprisonment of up to three years, or a fine of up to 1 crore rupees, or both, rising to three to five years and a fine of 1 to 2 crore rupees on a repeat conviction. Advertising carries up to two years, or up to 50 lakh rupees, or both. Facilitating the payments carries up to three years, or up to 1 crore rupees, or both. The offering and payment-facilitation offences are cognizable and non-bailable, which means arrest without a warrant is on the table.
The Act reaches offshore operators as well: services run from outside India but accessible to users in India are covered, so a Curacao licence is not the shield it is often presented as. Non-compliant platforms can also be blocked from public access under the Information Technology Act, 2000.
Where the Individual Player Stands
This is the part most articles get wrong in one direction or the other, so it is worth being exact. The penal provisions of the Act are aimed at the supply side: operators, the people who aid them, advertisers and promoters, and the banks and intermediaries that process the money. Legal commentary reading the statute is consistent that the person who merely plays or bets is not made an offender by it.
That is not the same thing as the activity being safe or lawful to supply to you. The practical position in 2026 looks like this:
- The service is unlawful to offer to anyone in India, so there is no Indian regulator to complain to and no consumer protection if a balance disappears.
- Your bank or payment provider is prohibited from processing the transaction, so any deposit route into such a platform, UPI included, is running against an express legal bar. Payments can be declined, reversed, frozen or flagged, and the intermediary that carried them is the one facing the criminal exposure.
- The platform itself can be blocked at any time, potentially with your balance still on it.
- Tax liability on winnings does not disappear because the operator ignores it.
The Litigation Is Still Running
The Act is being challenged. On 8 September 2025 the Supreme Court transferred to itself all the constitutional petitions that had been filed in the Delhi, Karnataka and Madhya Pradesh High Courts, and directed that similar challenges elsewhere stand transferred too. Petitioners argue Articles 14, 19(1)(g) and 21. As of this writing the challenge is still pending, no interim stay of the prohibition has been reported, and the Act and Rules have been in force since 1 May 2026.
A separate ruling is often misread as relevant. On 27 May 2026 the Supreme Court held that organised online games played for money on an uncertain outcome count as betting and gambling for tax purposes, and that 28 percent GST applies to the full face value of player deposits rather than to the platform's commission. That decision settles the tax bill of the domestic real-money industry that the Act shut down. It is not a licence for anything.
What Is Still Legal: The Game Itself
The Act is not anti-gaming. It splits the sector in three. Online money games are prohibited. Online social games and e-sports are recognised, and e-sports is actively promoted. The 2026 Rules also set up the Online Gaming Authority of India, a six-member regulator chaired by an Additional Secretary at MeitY with Joint Secretaries from Home Affairs, Information and Broadcasting, Youth Affairs and Sports, Financial Services and Legal Affairs, to classify games, run registration and handle grievances.
E-sports in the Act's sense means competitive skill-based play without wagering on the outcome. Playing BGMI is legal. Competing for prize money in a Krafton event is legal. Watching, analysing and following the scene is legal. Staking money on who wins the match is the part that is not.
The 2026 Competitive Calendar
Krafton India runs the circuit itself through four properties: BGIS, the Battlegrounds Mobile India Series; BMPS, the Pro Series; BMSD, the Showdown; and BMIC, the International Cup, with support for four open tournaments alongside them.
BGIS is the open national championship, thousands of squads grinding through online qualifiers down to a LAN final, and its roll of honour is a standing argument against assuming the big brands win: Gladiators Esports took the 2023 edition, Team XSpark 2024, Team Versatile 2025 and iQOO Soul 2026, with the prize pool climbing to 4 crore rupees. BMSD is the invite-only one, drawing its field off the Krafton India Esports leaderboard and BGIS and BMPS results rather than open registration. BMIC is the international event, pulling teams from India, South Korea and Japan.

How Battle Royale Differs, for Readers Outside India
Where licensed esports betting exists, the structural point about battle royale still holds and it is worth understanding even if you are only reading the odds screen out of curiosity. Sixteen four-player squads drop into a single lobby and one squad wins, so even a dominant team converts only a minority of individual maps and single-map winner prices run very long. Placement and head-to-head markets strip out most of the lobby and reward form reading instead of zone luck, and a multi-day final aggregating eighteen to twenty-four maps is simply a larger sample than any one map can be.
None of that shifts the Indian position by a millimetre. Inside India, the market you would be pricing is one that nobody may lawfully offer you, advertise to you, or move your money for. Follow the scene, watch the LANs, and keep the wagering out of it.
