Betting in Kenya: New Regulator, and a Tax That Now Bites on Deposits

If you last read a Kenyan betting guide a year ago, two of its facts are now wrong. The regulator changed, and so did where the tax lands. The second one is the one that costs you money.
The BCLB No Longer Exists
The Gambling Control Act 2025 was passed on 7 August 2025 and came into force on 26 August 2025, replacing a licensing framework that dated back to 1966. It created the Gambling Regulatory Authority, and the GRA took over the functions, assets and obligations of the Betting Control and Licensing Board. Existing BCLB licences stayed valid until expiry, and annual applications were suspended while the handover ran to the end of February 2026.
Two changes are worth noticing as a player rather than as an operator. Operator licences now run 36 months instead of twelve, which removes the annual scramble that used to leave books in limbo. And the Act obliges the Authority to run real-time monitoring of gambling transactions — a polite way of saying the regulator now sees the flow, not just the paperwork.
Where the Tax Sits Is the Real Story
Kenya used to tax betting the way most countries do: excise on the stake, withholding on the winnings. From 1 July 2025 it moved both.
Excise duty fell from 15% of the amount staked to 5% of the amount deposited into your wallet. Withholding went from 20% of net winnings to 5% of the amount withdrawn. Read that second one twice. It attached to a withdrawal, not to a win, so a player who deposited, lost interest and pulled the unspent balance back out was taxed on their own money. Bowmans flagged the constitutional problem with that publicly, and it was not a small point.
Then the Finance Act 2026 reintroduced withholding tax on betting and lottery winnings at 20%, levied on winnings minus stake, for residents and non-residents alike.
Here is the part nobody puts in a guide. A levy on money entering is a different animal from a tax on winning, because it charges you for a habit rather than for an outcome. It punishes exactly what Kenya's payment infrastructure encourages: a dozen small top-ups across an evening, each one paying the levy again. Funding an account once is materially cheaper than funding it twelve times, and that has nothing to do with how well you pick.
Treat every figure above as a snapshot with a date on it. Kenya has changed this regime three times in about eighteen months, and there is always another Finance Act coming.
M-Pesa Makes Everything Faster, Including the Mistakes
M-Pesa is the rail almost every Kenyan bettor actually uses, usually through a paybill or an in-app prompt, and deposits are instant. Withdrawals return to the same number and the first one waits on verification. Because the wallet is tied to your registered phone identity, a mismatch between account details and M-Pesa registration is the standard reason a payout hangs.
The convenience is genuinely the risk. A stream on the phone, a market on the same phone, and a wallet one PIN away removes every pause that used to exist between deciding and staking. That is a reason to set a deposit limit before your first bet rather than after your first bad night.
